IDRIZ XHOMARA, <\/strong><\/p>\n<p><strong>Ministria e Bujq\u00ebsis\u00eb, Tiran\u00eb\u00a0<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Shkrimtari dhe publicisti Ndue Dedaj, pas shum\u00eb botimesh letrare e studimore, tre vite m\u00eb par\u00eb doli para lexuesit me librin interesant: \u201cKanuni mes kuptimit dhe keqkuptimit.<!--more--> Sigurisht q\u00eb n\u00eb k\u00ebt\u00eb shkrim tonin nuk synohet nj\u00eb analiz\u00eb e k\u00ebtij libri, pasi pak gj\u00ebra kan\u00eb mbetur pa th\u00ebn\u00eb p\u00ebr t\u00eb, duke p\u00ebrfshir\u00eb dhe studiuesit m\u00eb n\u00eb z\u00eb t\u00eb fush\u00ebs s\u00eb t\u00eb Drejt\u00ebs, si prof. Ismet Elezi, por iu rikthyem k\u00ebtij libri p\u00ebr faktin se mbart mesazhe aktuale jo vet\u00ebm p\u00ebr deformimin e Kanunit, po dhe p\u00ebr parandalimin e krimit t\u00eb vrasjes n\u00eb t\u00ebr\u00ebsi n\u00eb dit\u00ebt e sotme.<\/p>\n<p>Autori vjen nga Mirdita, nj\u00eb trev\u00eb gjeografikisht shum\u00eb e af\u00ebrt me trev\u00ebn time, Matin dhe n\u00eb librin e tij ka fokusuar m\u00eb shum\u00eb Kanunin e Lek\u00eb Dukagjinit, nd\u00ebrkoh\u00eb q\u00eb nd\u00ebr matjan\u00eb ka vepruar Kanuni i Sk\u00ebnderbeut, si\u00e7 kan\u00eb vepruar Kanuni i Dibr\u00ebs, Lab\u00ebris\u00eb, \u00c7ermenik\u00ebs. Bile prej k\u00ebtu mund t\u00eb mendohet se nuk ka qen\u00eb nevoja n\u00eb k\u00ebt\u00eb lib\u00ebr t\u00eb b\u00ebhet nj\u00eb krahasim midis k\u00ebtyre kanuneve (un\u00eb nuk mund t\u00eb pretendoj t\u00eb b\u00ebj shtrirjen kohore t\u00eb tyre), por lexuesit t\u00eb k\u00ebtij libri i jepet mund\u00ebsia t\u00eb zbuloj\u00eb dhe nuancat q\u00eb lidhen me koh\u00ebn e funksionimit t\u00eb k\u00ebtij Kodi shqiptar, duke b\u00ebr\u00eb sigurisht dhe p\u00ebrqasjet e nevojshme lidhur me trevat ku ka lindur domosdoshm\u00ebria e funksionimit t\u00eb tij. Por sidoqoft\u00eb n\u00eb k\u00ebt\u00eb rast ndihmesa e lexuesit e b\u00ebn at\u00eb shum\u00eb dimensional, duke e pasuruar me p\u00ebrvoj\u00ebn e tij.<\/p>\n<p>Se \u00e7far\u00eb ka qen\u00eb Kanuni n\u00eb vetvete, nj\u00eb p\u00ebrcaktim i qart\u00eb i tij b\u00ebhet qysh n\u00eb balad\u00ebn e Gjergj Elez Alis\u00eb, ky kreshniku i drejtohet bajlozit t\u00eb zi:<\/p>\n<p><em>Me ke lyp motren para se mejdanin,<\/em><\/p>\n<p><em>Me lyp berrrat para se \u00e7obanin, <\/em><\/p>\n<p><em>E jam dredh n\u00eb k\u00ebt\u00eb log me t\u00eb kallxue<\/em><\/p>\n<p><em>Se t\u00eb par\u00ebt nj\u00eb kanun ne na kan\u00eb lan\u00eb,<\/em><\/p>\n<p><em>Arm\u00ebt me i dhan\u00eb p\u00ebrpara e mandej gjan\u00eb.<\/em><\/p>\n<p>N\u00eb vitet e para t\u00eb hapjes me bot\u00ebn, kam patur rastin t\u00eb diskutoj me nj\u00eb Profesor t\u00eb Antropologjis\u00eb t\u00eb Universitetit t\u00eb Alabam\u00ebs, Norman Singer, i ftuar nga Ministria e Bujq\u00ebsis\u00eb dhe Ushqimit p\u00ebr nj\u00eb konsulenc\u00eb n\u00eb paket\u00ebn e legjislacionit p\u00ebr pron\u00ebsin\u00eb e tok\u00ebs. Pavar\u00ebsisht njohjes s\u00eb tij t\u00eb thell\u00eb dhe erudicionit q\u00eb zot\u00ebronte, nuk ishte e v\u00ebshtir\u00eb t\u00eb viheshin re dhe reminishencat e p\u00ebrceptimit t\u00eb tij t\u00eb m\u00ebparsh\u00ebm p\u00ebr universin shqiptar (nuk desha t\u00eb p\u00ebrmend q\u00eb ishte njohur dhe me propogand\u00ebn keqdash\u00ebse europiane, kuptohet t\u00eb gjeneruar dhe t\u00eb multiplifikuar nga fqinj\u00ebt tan\u00eb, se shqiptar\u00ebt jan\u00eb njer\u00ebz me bisht(!) I trajtova disa nene t\u00eb Kanunit, q\u00eb ishin disi m\u00eb t\u00eb kuptueshme p\u00ebr nj\u00eb t\u00eb huaj, dhe n\u00eb saj\u00eb t\u00eb p\u00ebrkthimit \u201cnolian\u201d t\u00eb Kanunit t\u00eb Lek\u00eb Dukagjinit nga Leonard Fox (duke iu referuar dhe Anton Logorecit e Martin Camajt), kanun q\u00eb si\u00e7 dihet q\u00eb mbledhur nga At Shtjefen Gje\u00e7ovi n\u00eb koh\u00ebn q\u00eb sh\u00ebrbente n\u00eb Gomsiqe t\u00eb Mirdit\u00ebs n\u00eb fillimet e shekullit XX. I paraqita profesor Norman midis t\u00eb tjerave kreun: \u201cVrasja e gruas p\u00ebr gjak\u201d, ku vrasja e gruas me barr\u00eb, sipas kanunit, ishte baraz me 7 gjaqe (por si\u00e7 duket Enveri nuk e kishte lexuar k\u00ebt\u00eb kur pushkatoi Liri Geg\u00ebn shtatzan\u00eb, nd\u00ebrkoh\u00eb q\u00eb shum\u00eb mjek\u00eb e jurist\u00eb i dol\u00ebn n\u00eb mbrojtje diktatorit.)<\/p>\n<p>Pastaj me mikun e huaj u ndal\u00ebm n\u00eb at\u00eb se si i kishte par\u00eb Kanuni t\u00eb drejtat dhe detyrimet n\u00eb l\u00ebmin e pron\u00ebsis\u00eb publike. K\u00ebshtu, udha e shtegu nd\u00ebrmjet dy megjeve lyp pashin e vet. ( Nyje 62: Udha e Katundit).Udha e lagjeve t\u00eb katundit do t\u00eb jet\u00eb e gjan\u00eb tet\u00eb p\u00ebllamb\u00eb, kat\u00ebr p\u00ebllamb\u00eb njani, kat\u00ebr p\u00ebllamb\u00eb tjetri; p\u00ebr t\u00eb ngulun t\u00eb gardhit nd\u00ebrmjet dy arnajve do t\u00eb lehen tet\u00eb p\u00ebllamb\u00eb, sa njani, sa tjetri; udha e madhe do t\u00eb jet\u00eb aq e gjan\u00eb, sa mund t\u00eb kaloj\u00eb kali me gjith\u00eb barr\u00eb. Po k\u00ebshtu trajtohet \u201cVija e Mullinit\u201d: Po kje nj\u00eb vij\u00eb uji, si e mullinjve t\u00eb bloj\u00ebs, si e arnajve, e me uj\u00ebt e k\u00ebsaj vije ujiten arnajt e bluejn\u00eb mullinjt, gur\u00ebt e mullinit do t\u00eb jesin n\u00eb t\u00eb that\u00eb e bim\u00ebt do t\u00eb ujiten. Se mullini e farka e kan\u00eb me rend. (Nyeja 71. Neni 359-360.) Vija e arnajve, si dhe e mullinjve asht p\u00ebr t\u00eb mir\u00eb t\u00eb shoq\u00ebnis\u00eb, doemos do t\u00eb kaloj\u00eb n\u00ebp\u00ebr at\u00eb vend, ku t\u2019i bie drejtimi. Kanuja ven detyr\u00eb me bajt\u00eb si t\u00eb leht\u00ebn, si t\u00eb rand\u00ebn. P\u00ebr nj\u00eb sht\u00ebpi s\u2019lehet me u tha nj\u00eb katund. \u201cE mira e p\u00ebrbashket i parav\u00ebhet damit t\u00eb ve\u00e7ante\u201d. Vija e katundit t\u00eb kalon rraz\u00eb votret\u201d&#8230;<\/p>\n<p>Mund t\u00eb zgjateshim dhe m\u00eb, por nuk e shohim t\u00eb nevojshme, m\u00eb mir\u00eb duke ia l\u00ebn\u00eb fjal\u00ebn At Giussepe (Zef) Valentinit, i cili n\u00eb vepr\u00ebn \u201cE drejta e Komuniteve n\u00eb Tradit\u00ebn Juridike Shqiptare, shkruan: \u201cN\u00eb shoq\u00ebrin\u00eb civile t\u00eb Kanunit, p\u00ebrtej familjes dhe p\u00ebrposht\u00eb shtetit, sundojn\u00eb parimet e v\u00ebllaz\u00ebris\u00eb e, p\u00ebr rrjedhim, t\u00eb lirise dhe barazis\u00eb, me shum\u00eb pak kufizime t\u00eb arsyeshme. Por a \u00ebsht\u00eb ky kuptim dhe sot? Libri i z. Dedaj na argumenton se, p\u00ebrkundrazi, ka nj\u00eb deformim t\u00eb madh. Media e njofton si vrasje kanunore at\u00eb t\u00eb nj\u00eb t\u00eb riu n\u00eb bilardo apo n\u00eb klub, pas nj\u00eb sherri t\u00eb \u00e7astit me bashk\u00ebmoshatar\u00ebt; vrasjen e nj\u00eb n\u00ebpun\u00ebsi shteti a t\u00eb zgjedhuri, po ashtu e em\u00ebrton vrasje kanunore. B\u00ebjm\u00eb pyetjen (do t\u00eb ishte tautologji t\u00eb b\u00ebnim krahasime stupide midis kanunit dhe legjislacionit bashk\u00ebkohor, dihet se Kanuni nuk kishte tagrin e Kodit Penal) Kanuni nxit, stimulon apo frenon dhe minimizon vrasjet? K\u00ebmb\u00ebz\u00ebn e pushk\u00ebs, thot\u00eb Kanuni, e t\u00ebrheqin 12 pend buaj, mendo sa e v\u00ebshtir\u00eb \u00ebsht\u00eb (kur dihet se mund ta t\u00ebrheq\u00eb dhe nj\u00eb f\u00ebmij\u00eb\u00a0 6-7 muajsh). Shtojm\u00eb k\u00ebtu dhe spekullimet jo t\u00eb pakta t\u00eb nga ashtuquajturat komisione a komitete t\u00eb pajtimit t\u00eb gjaqeve, q\u00eb jo vet\u00ebm n\u00eb nj\u00eb rast, i kan\u00eb kujtuar brezit aktual se paskan nj\u00eb gjak p\u00ebr t\u00eb marr\u00eb, q\u00eb ato nuk e dinin dhe me tej do t\u00eb ishte gjoja veprimi i komisionit duke p\u00ebrdorur pa asnj\u00eb tag\u00ebr nganj\u00ebher\u00eb dhe emrin e Anton \u00c7ett\u00ebs.<\/p>\n<p>S\u00eb fundi nj\u00eb episod mjaft dometh\u00ebn\u00ebs se si funksiononte dhe parandalonte Kanuni. Para kryengritjes mbar\u00ebpopullore t\u00eb 31 Korrikut 1943, organizohet n\u00eb fshatin Bru\u00e7, Fush\u00ebn e Ndredys\u00eb (n\u00eb kufirin midis Matit dhe Mirdit\u00ebs) nj\u00eb kuvend q\u00eb ka hyr\u00eb n\u00eb histori. Ka qen\u00eb gjith\u00ebp\u00ebrfshir\u00ebs (tani p\u00ebrdoret fjala pluralist), treva e Mirdit\u00ebs, apo bajraqet e Kthell\u00ebs, Selit\u00ebs, Rranx\u00ebs, p\u00ebrfaq\u00ebsoheshin nga Ndrec Lufi. Nj\u00eb nga pjes\u00ebmarr\u00ebsit hedh iden\u00eb q\u00eb p\u00ebr t\u00eb larguar garnizonin fashist nga Burreli, t\u00eb p\u00ebrdorej nj\u00eb taktik\u00eb e till\u00eb: dit\u00ebn e diel\u00eb, kur ushtar\u00ebt italian\u00eb b\u00ebnin banjo n\u00eb lumin e Matit, duke vendosur arm\u00ebt n\u00eb nj\u00eb armatur\u00eb t\u00eb improvizuar, pasi t\u2019u rr\u00ebmbeheshin arm\u00ebt, t\u00eb vriteshin (sigurisht t\u00eb rekrutuar me forc\u00eb nga Musolini). Esht\u00eb shum\u00eb interesante q\u00eb n\u00eb k\u00ebt\u00eb kuvend t\u00eb mbajtur n\u00eb Bru\u00e7 kjo ide \u00ebsht\u00eb kund\u00ebrshtuar unanimisht dhe \u00ebsht\u00eb vendosur q\u00eb t\u2019i b\u00ebhej ultimatum komand\u00ebs s\u00eb garnizonit dhe pastaj t\u00eb b\u00ebhej sulmi. Pra, as pushtuesi, t\u00eb mos vritej n\u00eb pabesi. Pas p\u00ebrpilimit t\u00eb ultimatumit nga t\u00eb gjith\u00eb forcat q\u00eb ndodheshin atje, ai p\u00ebrkthehet nga Xhemal Punavia, ish akademist i Moden\u00ebs, Itali, dhe filloi beteja, q\u00eb detyroi garnizonin fashist t\u00eb largohet nga Burreli. A mund t\u00eb akuzohet Kanuni, si\u00e7 ndodh rendom sot, kur d\u00ebgjon t\u00eb tilla histori? Qysh her\u00ebt kapidani i Mirdit\u00ebs kishte kund\u00ebrshtuar vrasjen e kadhiqiot\u00ebve t\u00eb \u00e7\u2019armatosur nga Ali Pash\u00eb Tepelena, fakt q\u00eb e gjejm\u00eb t\u00eb interpretuar dhe n\u00eb librin \u201cKanuni, mes kuptimit dhe keqkuptimit\u201d t\u00eb autorit Ndue Dedaj.<\/p>\n<p>Prandaj ky lib\u00ebr, n\u00eb t\u00eb v\u00ebrtet\u00eb i vonuar, ia vlen t\u00eb rekomandohet p\u00ebr shkollat, mediat, shoqatat q\u00eb merren me gjakmarrjen, t\u00eb ngujuarit dhe pajtimet, p\u00ebr t\u00eb kuptuar se si ka funksionuar kanuni dhe ku jan\u00eb teprimet dhe deformimet e tij n\u00eb koh\u00ebn e sotme. Nuk \u00ebsht\u00eb e rastit q\u00eb 12 vjet m\u00eb par\u00eb nj\u00eb variant i shkurtuar i k\u00ebtij botimi, i t\u00eb nj\u00ebjtit autor, \u00ebsht\u00eb botuar nga organizata humanitare Uorld Vision dhe \u00ebsht\u00eb shp\u00ebrndar\u00eb n\u00ebp\u00ebr shkollat e Shqip\u00ebris\u00eb.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>DR.
